§ 7. Eligibility Criteria.

  • Preservation easements may be purchased only upon parcels meeting all of the following criteria:

    (a)

    The parcel, or multiple contiguous parcels under one ownership, shall be no less than twenty-five (25) acres in area.

    (b)

    The parcel shall be wholly located within an Agricultural District (A-1), a Rural Area District (RA), or an Agricultural and Forestal District (Article 8E of the Zoning Ordinance) or any combination of such districts;

    (c)

    The parcel shall be capable of being subdivided or developed for nonagricultural uses without rezoning, based upon the underlying zoning (excluding any restrictions based upon enrollment in an Agricultural and Forestal District), or be considered by the Committee to be otherwise threatened for nonagricultural development;

    (d)

    (Reserved)

    (e)

    Any portion of a parcel that contains land required to be reserved or set aside for open space, recreation or similar purposes pursuant to the provisions of a conditional use permit, conditional zoning agreement or proffer, subdivision ordinance, or other action by the Board of Supervisors, or any ordinance or regulation shall be excluded from the Agricultural Reserve Program;
